The Hirer - Customer
The person or company booking The Pbooth Company equipment for their event. These terms and conditions set out an agreement and contract between the Hire Provider and the Hirer (Customer) for the hire of the Photo Booth for an agreed period of time and on a mutually agreed date, at a confirmed location.
Upon booking (either verbally or electronically) it is deemed that the Hirer (Customer) has read, fully understood and agreed to the Hire Providers Terms and Conditions, set out within the document. This written contract sets out the full intentions of the parties involved and supercedes any previous written or oral agreements made between the parties, during any consultation process.
Hire of the Photo Booth
The delivery and collection of the Photo Booth for hire is free within a 50 mile radius of the company offices (Oxford). Every mile thereafter will be charged at a rate of £2 per mile. This will be highlighted at the time of the booking. There may be an additional surcharge that will be applicable (up to £120) for events being held within the London area. Any congestion charges or parking fees that are necessary at the time will be added to the cost of the hire agreement (within reason). Booth packages are priced for hire up to and including midnight. Post midnight hire is at the discretion of the Hire Provider, and, if approved at the time of the booking, will incur additional hire charges.
Free upgrades (worth up to a value of £50) are available on a week day booking Monday - Thursday inclusive, which are at the discretion of The pbooth Company staff. Additional charges will apply for specific days during the calendar year - for example - Bank Holiday hire, New Year’s Eve hire etc. Details of these charges are available on request.
The Provider agrees to provide a Photo Booth operational and available for use for a minimum of 80% of the agreed service period, to permit maintenance of the Photo Booth should any be necessary. This includes the replacement of any photographic paper, checking of any technical or lighting equipment, or any issues that may arise during the hire of the equipment, which may be unforeseen at the outset of the hire time.
A deposit of £50 of the agreed rental charge is required to secure a reservation for the Photo Booth. This deposit is non refundable. The balance of the agreed rental charge is due 7 days before the event, and can be paid via BACS transfer, cash or card. Cleared funds must be confirmed prior to the start of the event. The Photo Booth hire time is designated as the length of the actual time outlined on the chosen hire package, plus any additional hours pre ordered and pre paid, all of which have been agreed prior to the start of the event. Any alterations at short notice to any timings, must be in agreement with all parties involved. If the Hirer (Customer) uses the equipment for a period in excess of the agreed service period additional rental charges will be payable by the Hirer (Customer) to the Hire Provider, calculated on a pro rata basis.
Payment of all additional rental charges must be made by the Hirer (Customer) before any additional service period commences.
Access, space & power requirements
The Hirer (Customer) will arrange for an appropriate space to be made available for the Photo Booth at the event venue. A minimum floor area of 3m x 3m is required. All of the equipment is for indoor use only in a weather proof area on a dry, level and hard surface flooring / ground. It will not be used outside, expect in exceptional circumstances, and with the agreement of the company and during favourable weather conditions.
The Hirer (Customer) will provide a mains electricity supply comprising a single 13amp socket located within the space designated for the Photo Booth, for exclusive use by the Photo Booth Butler.
If a guest book has been provided as part of the package, the Photo Booth Butler present during the event will advise guests that they can put a copy of the photograph into the booth as a memento of the night for the Customer. The Photo Booth Butler is not responsible for the guest book, and can only advise what has been requested. It is not their responsibility to ensure that all Photograph copies are included, and also how they are stuck into the book, with or without written comments made.
Date changes & cancellations
Any change of date is subject to the availability of the Photo Booth on the alternative date and receipt of a new booking contract.
In the event of the Hire Provider being unable to attend the event due to reasons beyond their control, such as (but not limited to) adverse weather conditions, road closures, vehicle breakdown, equipment malfunction, illness or death, the Hire Provider - The Oxfordshire Photo Booth Company Ltd liability will be limited to refunding all monies already paid by the Hirer (Customer) to the Hire Provider for the service that was expected. This will be refunded in full.
If the Hirer (Customer) cancels an agreed rental of the Photo Booth then the following refund guide will apply.
• The £50 deposit is non refundable once paid If a cancellation is made
• 6 weeks prior to the event date - 25% of the total agreed price will be paid
• 4-6 weeks prior to the event date - 50% of the total agreed price will be paid
• 2-4 weeks prior to the event date - 75% of the total agreed price will be paid
• 1-2 weeks prior to the event date - 100% of the total agreed price will be paid
Loss or damage to Hire Providers equipment
The Hirer (Customer) assumes complete responsibility for any loss or damage to the Hire Provider’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests during the hire period, or idle hours.
Any damage or loss to the Hire Provider’s equipment through any misuse, negligence, abuse or theft during the hire period or idle hour period becomes the responsibility off the Hirer (Customer). The Hirer (Customer) shall bear the cost of any such repair or replacement. In the event that the equipment becomes damaged beyond repair, the Hirer (Customer) shall bear the replacement cost, and also any additional cost as a result of affected future hire of the equipment.
Whilst we encourage the fun use of the booth, if the Booth Butler feels that the Photo Booth is not being treated in a respectful manner, they will be within their rights to ask the guest’s involved to leave the booth, and they will not be permitted to re-enter.
The pbooth copmany will not accept any abusive or threatening behaviour to any of our staff members attending the event. If this occurs we will stop the use of the booth and dismantle it with no refund applicable.
Smoking, food and beverages of any kind (alcoholic or soft drinks) are not permitted within the Photo Booth at any time. Guests will be made aware of this at the time, and if necessary, will be requested politely by the Booth Butler to refrain from taking any drink or food into the Photo Booth.
The Hirer (Customer) agrees to and understands the following :
All persons using the Photo Booth at the event hereby give to The pbooth company the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Photo Booth user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose, including social media forums.
In addition the Hirer (Customer) hereby releases, discharges and agrees to maintain The PBooth Company free from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy.
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.
This is the entire agreement between the Hire Provider and the Hirer (Customer) relating to the subject matter herein and shall not be modified except as agreed in writing by both parties.
In the unlikely event that it is not possible, other than for reasons beyond the Hire Provider’s control, to provide an operational Photo Booth for at least 80% of the agreed service period, the Hire Provider shall make a refund to the Hirer (Customer) calculated pro rata from the total charge made for the agreed service period.
Where the rental includes a photographic printer and for any reason printed photographs cannot be provided on site at the time of the event, the Hire Provider will place the photographs on the company website which the Hirer (Customer) and their guests can access to place an order for prints of any photographs. These will then be supplied and delivered by post, free of charge.
If no service is received, the Hire Provider’s maximum liability will be the return of all payments received from the Hirer (Customer). The Hire Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
